12/2024: The Belgian legislature have adopted the new act on private investigations

Those falling into this Act have until June 16, 2025, to get licensed.

The Act has major implications for companies doing business in Belgium, with new rules and formalities to be complied with for internal company investigations.

In a nutshell:

The new Act is not only applicable to private investigation activities, also to internal investigations or.       in-house investigation departments, HR or legal departments that occasionally investigate.

Applicable Companies need a license from the Belgian Ministry of Internal Affairs to conduct investigations. In-house investigators will also need an identification card issued by the same Ministry.

The license must be applied for within six months after the Act’s date of entry into

The Act mandates investigations are verified and documented as “legitimate interest” in actual or potential conflicts or proceedings.
