National Security Act 2023

The Home Office has published new guidance to support the security industry, including but not limited to those who work in private investigation, close protection, or advise on corporate security and risk, to understand where they may be at risk of committing an offence under the National Security Act 2023.

This guidance has been issued on GOV.UK to ensure it is available to all security professionals and representative bodies. You can find the guidance here

Our guidance is designed to support you in carrying out the necessary due diligence checks to ascertain if your client is a foreign state, or a body linked to a state, seeking to carry out damaging activity against the UK.

The services that you offer may be attractive to state actors and therefore puts you at greater risk of being approached by a state actor, or someone working on behalf of a state actor, to conduct activity that is criminalised under the National Security Act.

Therefore, we welcome you sharing this guidance across your membership to ensure they understand the new legislation and how to comply with it to protect themselves or their businesses from liability.
